This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our websites, create an account, use our platforms, make a reservation, purchase or use our Services, communicate with us, or otherwise interact with Nexus.

For purposes of this Privacy Policy, "Services" includes services provided by Nexus Compute, including services made available through the Global Supercomputing Network ("GSN").

GSN is a computing platform owned by Amaryllo Group and made available to customers through Nexus Compute. GSN may use infrastructure, technology, software, data centers, and other resources provided by Nexus, Amaryllo Group or its affiliates, and independent third-party Suppliers.

This Privacy Policy applies to personal information processed by Nexus in connection with the Services. Certain Services or business relationships may be subject to additional privacy notices or data processing agreements.

2. Who We Are

Nexus Compute Corp. is the entity responsible for the processing of personal information described in this Privacy Policy, except where another entity is expressly identified as responsible under an applicable agreement or privacy notice.

For certain Services, Nexus may process personal information on behalf of a business customer. In those circumstances, Nexus may act as a data processor or service provider, and the applicable customer may remain responsible for determining how and why the information is processed.

Amaryllo Group may provide infrastructure, technology, software, operational support, or other resources used to provide GSN or the Services. This does not by itself make Amaryllo Group the controller of personal information processed by Nexus in connection with your direct relationship with Nexus.

The types of personal information we collect depend on how you interact with us and which Services you use.

Payment card information may be processed directly by third-party payment processors. We generally do not store complete payment card numbers on our own systems.

Nexus processes Customer Content primarily to provide the Services and in accordance with the applicable Terms, agreement, or data processing arrangement.

You are responsible for ensuring that you have the necessary rights and permissions to provide Customer Content to us and to have it processed through the Services.

4. How We Use Personal Information

We may use personal information to:

  • provide, operate, maintain, and support the Services;

  • create and manage accounts;

  • process reservations, orders, payments, and transactions;

  • provision and manage computing Resources;

  • communicate with you regarding your account, reservations, Services, and support requests;

  • authenticate users and secure accounts;

  • detect, investigate, and prevent fraud, abuse, security incidents, and unauthorized access;

  • monitor and maintain the security, availability, and performance of our Services;

  • troubleshoot technical problems;

  • comply with legal and regulatory obligations;

  • enforce our Terms, Acceptable Use Guidelines, and other agreements;

  • respond to legal requests and protect our rights and the rights of others;

  • improve our Services, systems, and user experience;

  • send service-related communications; and

  • send marketing communications where permitted by applicable law and in accordance with your preferences.

Certain computing Resources or infrastructure may be provided by independent third-party Suppliers.

Where necessary to provide a reserved Resource or other Service, we may share relevant information with the applicable Supplier. We will limit such information to what is reasonably necessary for the applicable Service.

6.4 Business Transactions

If Nexus or substantially all of its assets are involved in a merger, acquisition, financing, reorganization, sale, or similar transaction, personal information may be transferred as part of that transaction, subject to applicable legal requirements.

6.5 Legal and Regulatory Requirements

We may disclose personal information where reasonably necessary to:

  • comply with applicable laws or regulations;

  • respond to lawful requests from authorities;

  • comply with court orders or legal processes;

We do not sell personal information or share personal information with third parties for their own independent marketing purposes.

If you use Nexus Services through an organization, your organization may control certain information associated with your account and use of the Services.
